Terms of Service
The TomFrog Directory Submission Service is provided to you under the terms and conditions of this Agreement:
1. Terms of Service Acceptance
By submitting the site submission form, you:
(a) represent and warrant that you are of age to be legally bound by this agreement;
(b) agree to provide true information, regarding your personal information and your site submission;
(c) agree to be bound by this agreement.
2. Service Description
2.1 TomFrog's site submission service is a paid service. You accept to pay the current submission fee for the review
of your site's submission and possible listing in TomFrog's Directory. That listing is not guaranteed. TomFrog is a
business and family oriented web directory, with an editorial policy, and the acceptance of your site in Tomfrog's
Directory is subject to a review that will judge, in TomFrog's sole descretion, your site's compliance with TomFrog's
editorial policy. TomFrog agrees that it's editorial team will review and respond to your submission within 3
business days from your submission date.
2.2 If your site is accepted for listing in TomFrog's Directory, then your site's continued listing in the Directory
will be subject to an additional review each year and to the applicable, then-current recurring annual fee.
2.3 The current fee for TomFrog's site submission service is US $19.99 applicable for each submission. This fee is
also applicable to the recurring anual review and relisting.
2.4 Tomfrog will refund 100% of your payment, if your site's submission is refused.
3 Your representation and warrant
You represent and warrant that the site submitted for listing does not and will not infringe the rights of any third
party. You also warrant and represent that your site complies with all applicable laws and regulations.
4. Editorial Policy
4.1 TomFrog's review of your site will judge your site's compliance with TomFrog's editorial policy. The following
guidelines represent a brief indication of that policy.
(a) Ecommerce sites must publish the official business name and mailing address;
(b) The site must define its purpose, products, and/or services;
(c) The site must not contain any parts under construction;
(d) All links on the site must function properly;
(e) The site must be in the English language (or have an English version available);
(f) The site must support multiple browsers and capabilities (e.g., no Java-only sites);
(g) The site must be up and running 24 hours a day, 7 days a week;
(h) The site must not be dedicated to directing the user to another page;
(i) The page may not give the search engine different content than what the end-user sees;
(j) The site must not offer services, products, information and link related primarily to online gambling;
(l) The site must not offer services, products, information and link related primarily to prescription drugs;
(m) The site must not offer services, products, information and link related to pornographic content;
(n) The site must not offer services, products, information and link related to affiliation programs;
(o) Write good and exlusive descriptions and a title pertaining your site's content;
(p) The site must contain unique content, as determined by TomFrog;
(q) Use proper case for significant words in the title. Capitalize the first letter of each sentence in descriptions,
as well as proper nouns. Submissions that contain fields in all UPPER CASE or all lower case will not be
accepted;
(r) Submit titles and descriptions in English only;
(s) Both homepage and inner page submissions are accepted, as long as they are submitted to an appropriate
category.
4.2 If TomFrog accepts your site for listing in TomFrog's Directory, TomFrog will consider your site's submission
information, but reserves the right to list your site in any category or subcategory, rewrite your site's description
and title, as TomFrog deems appropriate.
5. Privacy Policy
5.1 TomFrog maintains the personal information and the site information you submitted in your submission request. You
agree that Tomfrog may use that information for your site's submission, review, listing and relisting status and
marketing purposes, including TomFrog's Directory news and promotions.
5.2 You agree that TomFrog may disclose such information in the good faith belief that such action is reasonably
necessary: (a) to comply with the law or legal process; (b) to enforce this Agreement; or (c) to protect the rights
or interests of TomFrog or others.
6 Notices
6.1 Any notices or communications under this Agreement shall be by electronic mail and shall be deemed delivered upon
receipt to the party to whom such communication is directed, at the addresses specified below. If to TomFrog, such
notices shall be addressed to sales@tomfrog.com. If to you, such notices shall be addressed to the electronic mail
that you specified in your site's submission request. It is your responsibility to provide an accurate electronic
mail and to ensure that TomFrog is notified of any changes to your electronic mail.
